Tatjana Prawitz - Fine Art Photography
§ 1 Scope
(1) Thefollowing General Terms and Conditions apply to all contracts between Tatjana Prawitz – Fine Art Photography, Goldbekufer 40, 22303 Hamburg, and the customer, which are concluded in the version valid at the time of the order and whose knowledge and inclusionthe customer acknowledges and confirms by placing an order with Tatjana Prawitz - Fine Art Photography.
(2) Tatjana Prawitz – Fine Art Photography does not recognise any deviating terms and conditions of the customer unless Tatjana Prawitz – Fine Art Photography has expressly agreed to their validity in writing.
§ 2 Conclusion of contract
(1) The presentation of Tatjana Prawitz – Fine Art Photography products on the internet does not constitute a legally binding offer, but rather a non-binding online catalogue. By ordering the desired goods, a customer submits a binding offer to conclude a purchase contract for the products contained in the shopping cart.
(2) Upon receipt of an order in my online shop, the following provisions apply: The customer submits a binding contractual offer by successfully completing the order procedure provided in my online shop.
The order is placed in the following steps:
1.) Selection of the desired goods
2.) Confirm by clicking on the “Add to cart” button.
3.) Checking the details in the shopping cart
4.) Click on the ‘Proceed to checkout’ button.
5.) Entering the billing/delivery address
6.) Rechecking or correcting the respective data entered
7.) Confirm by ticking the checkbox that the customer agrees to the terms and conditions and privacy policy with their order and has read and understood the cancellation policy.
8.) Binding submission of the order by clicking on the button ‘Buy now’, ‘Pay with PayPal’, ‘Pay with G Pay’ or ‘Pay with Apple Pay’.
(3) Confirmation of receipt of the order shall be made upon acceptance of the order by means of an automated confirmation email. Upon sending this confirmation email, the customer's offer shall be accepted and the purchase contract shall be concluded. Immediately after sending the confirmation email, the invoice shall be sent in a separate invoice email. Cancellations and changes to the order are no longer possible at this point.
(4) The contract text is not stored separately by Tatjana Prawitz – Fine Art Photography. The order details and terms and conditions are made available to the customer in the order confirmation email. The current version of the terms and conditions can also be accessed at https://prawitz.de/termsandconditions. For security reasons, order data is not accessible via the Internet.
(5) Tatjana Prawitz – Fine Art Photography reserves the right in individual cases to refuse orders that do not meet the specified requirements of Tatjana Prawitz – Fine Art Photography or where the customer is known to be credit unworthy.
(6) Tatjana Prawitz – Fine Art Photography only accepts orders to delivery addresses within the Federal Republic of Germany, Austria, Luxembourg, France, Italy, Belgium, Netherlands, Spain, Ireland, Sweden, Finland, Denmark, Portugal, Poland, Czechia, Bulgaria, Romania, Croatia, Hungary, Latvia, Estonia, Lithuania, Slovakia, Slovenia and Greece.Any payments already made will be refunded.
(7) Tatjana Prawitz – Fine Art Photography is entitled to correct prices that have been incorrectly stated in the online shop. The customer may withdraw from their submitted offer if a correction of the price leads to a price increase.
§ 3 Copyright
(1) By purchasing a photographic print, the customer acquires only the physical ownership of the print. No other rights of use are granted. Any reproduction (duplication), editing, distribution, rental, public display or other analogue or digital exploitation is not permitted, unless permitted by law.
(2) The customer is permitted to resell the product.
§ 4 Delivery
(1) Delivery times depend on the size and material of the product, are displayed in the shopping cart and checkout area, and can also be viewed at any time at https://prawitz.de/deliverytimes .
(2) Unless otherwise agreed in writing, delivery shall be made from the production facility to the customer's address or to the delivery address specified by the customer.
(3) If you select the payment method ‘Direct bank transfer’, the delivery period for the goods shall commence upon receipt of payment at the bank account specified in the confirmation email or invoice.
(4) If one of the other payment methods is selected, the period shall commence on the day after the contract is concluded.
(5) If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline shall end on the next working day.
(6) Tatjana Prawitz – Fine Art Photography is entitled to make partial deliveries, provided this is reasonable for the customer.
(7) Orders and any services provided to the customer will be suspended by Tatjana Prawitz – Fine Art Photography as long as the customer is still in default of payment with regard to other contracts. Payments will first be offset against outstanding claims and costs in chronological order of their respective due dates.
(8) It is in the interest of Tatjana Prawitz – Fine Art Photography to always adhere to the specified delivery times when concluding a contract. If, in exceptional cases, Tatjana Prawitz – Fine Art Photography is unable to adhere to the specified delivery times, the customer is free to withdraw from the contract within the framework of the following provisions.
(9) Tatjana Prawitz – Fine Art Photography shall grant a grace period of two weeks for delivery, which shall commence upon receipt of the customer's notice of grace period by Tatjana Prawitz – Fine Art Photography. This grace period shall be invalid if the grace period is unreasonable for the customer. This shall be the case in particular if the customer's interest in a grace period ceases to exist for compelling, legally permissible reasons or if it is a so-called fixed-date transaction.
(10) Deviations from the stated non-binding delivery times shall only entitle the customer to assert claims for damages if the deviations are not merely minor and Tatjana Prawitz – Fine Art Photography is also responsible for the delay in delivery.
(11) If delivery delays are due to reasons for which Tatjana Prawitz – Fine Art Photography is not responsible (force majeure, fault of third parties, etc.), the delivery period shall be extended appropriately. However, Tatjana Prawitz – Fine Art Photography reserves the right to withdraw from the contract without incurring any liability for damages. Tatjana Prawitz – Fine Art Photography shall not be in default of delivery for the period of the delivery disruption. Services already paid for shall be refunded in the event of withdrawal.
(12) Delivery delays do not entitle the customer to refuse acceptance. Non-arrival of deliveries must be reported within 14 working days of the order being placed. If the customer fails to report this, the goods shall be deemed to have been successfully delivered.
(13) If the customer is not at home when the parcel is delivered and the parcel is not collected by the customer from their post office within 7 working days, or if the customer refuses to accept the parcel, Tatjana Prawitz – Fine Art Photography has the right to cancel the order and withdraw from the contract and to demand compensation for the damage incurred in this respect, including any additional expenses. Further claims remain reserved. If the above conditions are met, the risk of accidental loss or accidental deterioration of the purchased item shall pass to the customer at the point in time at which the customer accepts delivery.
(14) In the event of non-obvious transport damage, the customer is obliged to report the damage together with the damaged goods to the delivery service as soon as possible or within 7 days and to forward the confirmation of the report to Tatjana Prawitz – Fine Art Photography without delay. This must be done before returning the goods to Tatjana Prawitz – Fine Art Photography. Only in the event of an official damage report is Tatjana Prawitz – Fine Art Photography able to claim damages from the carrier or the transport insurance company. Any damage must be reported immediately. The customer shall bear the direct costs of returning the goods.
(15) If goods are delivered with obvious transport damage, the customer should complain about the damage to the delivery agent immediately, if possible, and contact Tatjana Prawitz – Fine Art Photography without delay. Failure to complain or contact us has no consequences whatsoever for the customer's legal claims and their enforcement, in particular the customer's warranty rights. Only in the event of an official damage report is Tatjana Prawitz – Fine Art Photography able to claim damages from the carrier or transport insurance company.
(16) If the damage was only noticed after unpacking the parcel, a complaint about transport damage is also possible after delivery. In this case, the customer is obliged to report the damage to the delivery service as soon as possible, or within a period of 7 days, and to forward the confirmation of the damage report to Tatjana Prawitz – Fine Art Photography without delay. Here too, Tatjana Prawitz – Fine Art Photography can only claim the damage from the carrier or transport insurance company with an official damage report.
§ 5 Prices and shipping costs
(1) All prices are in euros and include the applicable statutory value added tax and do not include shipping costs (including packaging, transport costs, transport insurance, delivery), which depend on the size and material of the product and will be charged to the customer.
(2) The prices and shipping costs applicable at the time of ordering shall apply. The prices of the goods can be found on the respective product page. The shipping costs are displayed in the shopping cart and at checkout and can also be viewed at any time at https://prawitz.de/shippingcosts .
(3) Should additional shipping costs arise due to the customer providing incorrect delivery addresses or addressees, these will be charged to the customer.
§ 6 Terms of payment
(1) The customer has the option of paying by direct bank transfer, PayPal, G Pay, Apple Pay or credit card (American Express, Mastercard, Visa).
(2) If the customer has chosen to pay by direct bank transfer, they undertake to pay the purchase price immediately after conclusion of the contract.
(3) If the payment method ‘direct bank transfer’ is selected, Tatjana Prawitz – Fine Art Photography will provide the bank details in the confirmation email or on the invoice sent to the customer with the invoice email.
(4) In order to pay the invoice amount via PayPal, the customer must be registered there or first register, authenticate with their access data and confirm the payment instruction to Tatjana Prawitz – Fine Art Photography. The payment transaction will be carried out automatically by PayPal immediately afterwards.
(5) In order to pay the invoice amount via G Pay, the customer must be registered there or first register, authenticate themselves with their access data and confirm the payment instruction to Tatjana Prawitz – Fine Art Photography. The payment transaction will be carried out automatically by G Pay immediately afterwards.
(6) In order to pay the invoice amount via Apple Pay, the customer must be registered there or first register, authenticate themselves with their access data and confirm the payment instruction to Tatjana Prawitz – Fine Art Photography. The payment transaction will be carried out automatically by Apple Pay immediately afterwards.
(7) If the customer fails to meet their payment obligations, Tatjana Prawitz – Fine Art Photography shall be entitled to demand payment of the entire outstanding debt. This shall apply in particular if payments are suspended or reversed and the customer's general creditworthiness is in question.
§ 7 Retention of title
The delivered goods remain the property of Tatjana Prawitz – Fine Art Photography until the purchase price has been paid in full and final. The customer shall not be entitled to offset any claims.
§ 8 Warranty
(1) No guarantee is given for the fading or water resistance of printed products. Tatjana Prawitz – Fine Art Photography points out that products that are not specifically designated for outdoor use are intended exclusively for use in closed rooms.
(2) The descriptions and specifications specified upon conclusion of the contract represent the technical status at that time. Minor technical deviations (in particular image cropping and colourfulness of the printout) of the delivered goods from the advertised goods are permissible and do not constitute a defect, provided that they are within the scope of normal commercial practice and do not significantly restrict the contractual purpose.
Images that are cropped may deviate slightly, but not significantly, from the specified sizes, as is common with standard frames.
Minor, commercially acceptable colour differences in the printout may occur if the customer's monitor is calibrated differently and is not colour-fast.
Black and white prints may contain a slight, commercially acceptable colour cast due to colour printing.
Complaints, credit notes and replacement prints in this regard are excluded, unless the deviation is outside the scope of normal commercial practice.
(3) The limitation period for claims for material defects is two years from receipt of the goods. For entrepreneurs, a limitation period of one year applies in accordance with Section 14 of the German Civil Code (BGB).
(4) For merchants, the legal provisions, inspection and notification obligations pursuant to Section 377 of the German Commercial Code (HGB) apply.
§ 9 Limitation of liability
(1) Tatjana Prawitz – Fine Art Photography shall be liable in all cases for damage to life, limb and health.
(2) Tatjana Prawitz – Fine Art Photography shall be liable for damages resulting from intentional or grossly negligent conduct. This also applies to indirect consequential damages, such as lost profits in particular.
(3) Tatjana Prawitz – Fine Art Photography shall only be liable for damages incurred by customers that are attributable to slight negligence if a material contractual obligation (cardinal obligation) has been breached. Liability is limited to the damages typically foreseeable at the time of conclusion of the contract and, in all other respects, to the average damages typical for the contract. This also applies to indirect consequential damages, such as lost profits in particular. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract and on whose compliance the customer may rely.
(4) Liability towards consumers shall be limited to the damage typically foreseeable at the time of conclusion of the contract and, in all other respects, to the average damage typical for the contract, except in cases of intentional or grossly negligent behaviour or in cases of damage resulting from injury to life, limb or health. This shall also apply to indirect consequential damage, such as loss of profit in particular.
(5) For damages caused by entrepreneurs that are attributable to slight negligence, liability shall be limited to the damages typically foreseeable at the time of conclusion of the contract and to twice the order value. This also applies to indirect consequential damages, such as lost profits in particular.
(6) Alle Haftungsbegrenzungen der Absätze 1 bis 4 gelten sinngemäß auch zugunsten gesetzlicher Vertreter und Erfüllungsgehilfen von Tatjana Prawitz – Fine Art Photography.
(7) Claims for liability under the Product Liability Act remain unaffected.
§ 10 Privacy
With regard to data protection, the data protection information provided by Tatjana Prawitz – Fine Art Photography applies (https://prawitz.de/privacypolicy).
§ 11 Cancellation policy
The right of revocation and return for distance contracts pursuant to Section 312 g (1) of the German Civil Code (BGB) is excluded pursuant to Section 312 g (2) No. 1 BGB if the manufacture of the goods is based on an individual selection or determination by the consumer or if they are clearly tailored to the personal needs of the consumer. For this reason, there is no right of withdrawal for any photo products from Tatjana Prawitz – Fine Art Photography .
If, in exceptional cases (only for prefabricated products), a right of withdrawal does exist, the following applies to the customer within the meaning of Section 13 of the German Civil Code (BGB):

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund.
We may refuse to refund until we have received the goods in their original packaging and undamaged, or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.

§ 12 Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provision
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the customer has their habitual residence shall remain unaffected.
(2) The language available for the conclusion of the contract is German.
(3) If the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, or moves their place of residence abroad after conclusion of the contract, or their place of residence is unknown at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from the business relationship between the customer and Tatjana Prawitz – Fine Art Photography. headquarters of Tatjana Prawitz – Fine Art Photography.The place of jurisdiction is therefore Hamburg.
(4) Should individual provisions of this contract be invalid or contradict statutory provisions, this shall not affect the remainder of the contract.
(5) Tatjana Prawitz – Fine Art Photography reserves the right to change the General Terms and Conditions at any time without giving reasons. The customer will be clearly notified of any changes on this page. Any changes to the General Terms and Conditions require the customer's renewed consent.
